You need to ask Apple to reset your security questions; this can be done by phoning AppleCare and asking for the Account Security team, or clicking here and picking a method, or if your country isn't listed in either article, filling out and submitting this form.
They wouldn't be security questions if they could be bypassed without Apple verifying your identity.

If you've forgotten the answers to your security questions and you have a rescue email address (which is not the same thing as an alternate email address) set up on your account then you can try going to https://appleid.apple.com/ and click 'Manage your Apple ID' on the right-hand side of that page and log into your account. Then click on 'Password and Security' on the left-hand side of that page and on the right-hand side you might see an option to send security question reset info to your rescue email address.

There is no solution. You have to provide the ID and password. There is no way around it. If the person you bought it from can't provide it, return it and get your money back.

This is sometimes caused by a problem with the iTunesPrefs.xml file, normally found at C:\Users\<User>\AppData\Local\Apple Computer\iTunes\iTunesPrefs.xml. Try dragging this to the desktop and trying again.
Alternatively the problem may be that you have McAfee AV and it is preventing iTunes from updating the same file and thus causing the problem. See Why does iTunes delete my itunesprefs.xml? for details.

go to settings and sign out his apple id in the sections i tell you:
1.game center
2.itunes and appstore
3.messages
4.icloud(delete acount;it wont realy delete it will only remove from your ipad)
5.facetime
and then enter your icloud in each and every section

Short answer: You do NOT have to reinstall all your apps and copy your files back.
Longer answer: Upgrading the OS does not touch any user files. Upgrading the OS should not interfere with any applications which are compatible with Mavericks. In my experience non-Apple apps are generally left unchanged by the upgrade. It is possible that some apps may need to be upgraded. One good resource for checking application compatibility is RoaringApps.
Finally, it is always wise to backup everything, just in case.

An iPhone backup to a computer via iTunes stores the photos in a backup file that is only meant to be be used if needed to restore back to the phone. There is 3rd party "extractor" software available but otherwise the photos are not directly viewable.
The backup via iTunes was a good idea and your Camera Roll photos should be there and should be able to be restored to your new phone. However if it was me I wouldn't rely on that alone. I would also import the photos to a computer where you can see and verify that you have a copy. That is a good idea at any time (not just when you know you might need it). Any phone can be lost, broken, suffer hardware issues, etc at any time and lose all data on it. You can't delete it. Look on all your screens and inside all your folders. If you still can't find it go to Settings>General>Reset>Reset Home Screen Layout. This will restore the home screen to its original configuration but may move other apps around to do so.
