Stolen iPhone, Apple still repairing the phone

In 2012, my brand new iPhone5 was stolen from my bag.
A month after having been stolen said iPhone was taken to an Apple Store and replaced by an Apple Tech Support Agent. (Most likely to swap out for an ATT locked phone vs a Rogers locked Phone) Reason listed, broken buttons.
I have the case number from the perpitrators actions.
Can Apple help me track down the person responsible by giving me a name and location?
I did file a police report, but they found nothing.

Apple is NOT a law enforcement agency. Absent a court order, they don't have the legal right to refuse service on the device.
A class action against Apple such as you describe would be laughed out of court.

You have a password, so good move on your part. Whether you erase it or the thief does, they still get to use the iPhone as theirs. Which is more important (pick one), protecting your data or punishing the thief?
Ringing occurs at the carrier. Chances are you're going to voicemail after only two or three rings. If you have an iCloud backup also a good move. Re-read my question in the first paragraph.

I recently got my iPhone stolen with an Apple Care warranty. I know my phone is lost into the woods, but now, I just want to know if there's a possibility of me getting the Apple Care warranty of my old phone, on my new iPhone. Because I don't feel like paying 100$ for it one more time..

you want to transfer your applecare agreement to another phone, correct?
You should contact AppleCare technical for that one, they might be able to transfer it, depending on exact conditions, like the purchase date of the old phone. No garantuees, though.

You can only obtain warranty OR post warranty service in the country of original purchase
As your iPhone has user damage it has no warranty
IF the iPhone originated from Spain or another EU country you can get out of warranty service in any EU country

Are you sure? I have other devices at home. The only way I can make them disappear on the tracking list is by turning off location or resetting to factory settings.
I just want to make sure I'm not tracking a phantom that I will never recover :-(

You can't. Until the previous owner removes the activation lock, the device is useless to you; Apple won't remove it unless presented with proof that the registered owner is dead.

How do I make a new apple ID for the phone I gave my daughter, she is using mine still

My daughter took over my iphone 4 when I got the iphone 5, she still has my apple ID on the phone, How do I make her her own ID with out messing up the icloud on either of our phones, she doesn't want my apps and I don't want her to delete as it deletes off of my phone as well through the cloud.

TO create a new apple id go to
appleid.apple.com and create a new apple id
SEttings > iCloud (If she likes all the data on her phone, choose to keep data instead of delete when it prompts you to )
Settings > Facetime
SEttings > Messages > Send/recieve at
Settings > iTunes and App Store

I have no idea what may have caused your MacBook to stop working, but from your description it kind of sounds like it may have started before you ran Software Update and installed the new Apps. Just the general slow feeling and bugginess is what tips me off. You said that you weren't sure if you had closed all open windows, that doesn't matter if the computer restarts itself. It automatically closes all other open applications when restarting.
As to your data being retrievable, if when you take it in they do a fresh install of the OS, then no, it will not be unless you want to pay several thousand dollars to a software retrieval company.
I am glad to hear that you have taken into the Apple Store to get it fixed, and that you have all of your purchased music backed up to your iPod. You should be able to just transfer it all back to iTunes once you get your computer back should it be necessary.
As a side note, the proper place for this topic would probably in the MacBook forums, not iTunes since there is no evidence that iTunes started the issue.

As Peter says above, only an Apple Store genius can advise you.
But to further clarify, you seem to postulate that if Apple helps you, the cure would be a replacement. That is not necessarily true. Let them look at it and advise you what the remedy is. They may offer you nothing (saying it's your fault), or they may offer you a solution (keeping your current iPhone), or possibly a replacement.

Yes the phone belongs to me. It was purchased from United Kingdom Vodafone to West Africa, i had to factory unlock to use any sim in it. so it belongs to me. I did the activation myself, now after updating my iphone to the latest update, it required a user id and password to activate the phone, but anytime i enter the details, it tells me the user Id is not correct but the password is correct..

You do a restore as new to wipe the iPhone then at the end of restore you will be asked to restore from backup. Choose your iPhone backup.
Note you cannot restore an IOS newer than the IOS on iPhone, you need to update iPhone first.

In the Event mode use the View ➙ Sort ➙ By Date ➙ Decending menu option. Then the latest imports will be near the top of the Event window (depending on when the photos were taken of course).
Or Control-Click on one of the thumbnails in the Last Import album and select Show Event from the contextual menu:
