Why does my ipod need to have the newest os to allow games that won't go on it now but where on it before?

I have an Ipod touch (prob 1st or 2nd gen) that used to have a bunch of free games on for my kids and I upgraded to the newest os (so I could use Netflix) and when I did, the games had to be reinstalled. But when I go to install previously enjoyed (and previously working) games... they won't because the device says I need os 4.3 for the game. This seems like a scam to me!!!!
How do I get the old games back? and why isn't there compatibility with games I know worked on the ipod before?

Many developers when they updated their apps to support iOS 5 and 6 dropped compatibility for iOS 4.2.1 and earlier.
Your only way is if you have the version that was compatible on your computer such as in the recycle bin/trash or in a computer file backup. In that case delete the current version that is in your iTunes App library and replace it with the older version. Then sync.

    I dunno, that doesn't make any sense to me.
    I just shut down and rebooted into the SnowLeopard partition and took a peek at the preference panes.  There are only 3 that run in 32 bit only.  They are all 3rd party, and none of the prefpanes are non Intel.  Like I said, I have never owned a PPC machine.  Anyhow, SnowLeopard doesn't even have an iCloud prefpane, or a combined mail, contacts, and calenders prefpane, and the ML security and privacy prefpane is all new as well.  The software update prefpane is Intel and 64 bit in both SnowLeopard and Lion.
    As to the triple boot, unless I'm totally mistaken, what I have here is, in essence, 3 seperate descrete computers in one box.  All using the same hardware. but one at a time.  I wouldn't know how to get more than one running at the same time, without using a virtual machine, even if I wanted to.  (Which I don't)  I do sometimes transfer files from one to another using the shared folder, but other than that, they do not interact.  How could ML system preferences be trying to launch prefpanes from a totally different machine?

    Reset the device:
    Press and hold the Sleep/Wake button and the Home button together for at least ten seconds, until the Apple logo appears.
    If that doesn't help, tap Settings > General > Reset > Reset All Settings

    If you have a 3G iPod it may really be a 2G iPod. If it is 8 or 16 GB it is a 2G iPod.  Apple only made 32 and 64 GB 3G iPods. A 32 GB one can be either. To identify ours see:

    Sherlocked, There are a few ways you can solve that problem.
    If you do want to share the same library, use the capabililty to "Sync Selected Playlists," so that each iPod will only get the music that its owner wants.
    Alternatively, you can set up two separate libraries.  This is easiest if you use two different Windows user IDs on the computer.  Then each iPod owner can sync to his own library.

    Have you tried the standard fixes:
    - Reset
    Reset iPod touch:  Press and hold the On/Off Sleep/Wake button and the Home

    - Restoring from backup
    - Restoring to factory defaults/new iPod
    Are you using the headphone/mic?  If so sometimes sweat/moisture in the controls can make the iPod do strange things.
    What number are you looking for?
    If les than a year old, the Apple warranty still covers it.

    look around some more on the forum, there have been some BIOS betas released and can be studied about that may help you if you need a fix now... I know were alll eagerly awaiting aBIOS that will enable dual core for Neo 2 plat, at least I am, but then again I don;t KNOW for sure you'll have too do some research

    Ok so I just relaxed my iPod touch because my last one broke. Everything has been covered with iCloud, so I have everything I had before...accept for most of my photos. I had about 325 photos and ipthey are in photo stream (my iPad and iPod share the same photos) and I only received 24 pf them. The thing that ****** me off is that with the 24 photos I have it still says I have the photos I had before and it's making a lot of space on my iPod. All in all how can I get the old photos back?

    I managed to get rid of the phantom usage. Restoring iPhone and resetting the phone settings/data do not work for me.
    I had to move the Date on my phone earlier by 1,2,3 months and found the phantom photos in the Recently Deleted Folder. Next, I deleted the photos manually from the Recently Deleted Folder and the usage got freed up from my iPhone.
