Apple Customer Service and warranty exceptions

Hello all,
Whilst I love my Apple hardware and software, and have had many good experiences with them over the years, unfortunately I post today with a complaint about what I perceive to be poor customer service and product quality.
In late March/early April of 2006, I purchased a 1.83GHz MacBook Pro with great anticipation- Intel inside, Tiger OS, inbuilt webcam, and general awesomeness all round. I also purchased the 3 year AppleCare warranty, which was to be a godsend as during the following three years I would experience:
*The replacement of the battery under the original MacBook Pro battery exchange program
*The left fan on the unit dying in 2007
*The logic board itself dying in late Feb/Early March 2008, thus bricking my laptop
*Another battery replacement as the replacement for the original died before it (realistically) should have (Apple very nicely made an exception to the battery's 1 year technical warranty and replaced it for me).
Fair enough, it's a new unit and was bound to have some problems. Unfortunately, last week the logic board died AGAIN; a mere 18 months after it was replaced in 2008. The unit is out of AppleCare warranty by 5 months or so, but I was urged by forumites and friends to call Apple, who would surely make an exception for me and pay for the replacement part, given my service history with the laptop and Apple's reputation for excellent customer service.
Unfortunately, this has proved to not be the case. Calling customer service at Apple Australia I talked to Steven, who was firm to the point of rudeness when he stated that my laptop was out of warranty and Apple would cover nothing but the labour charges involved, as a "guesture of good will". When stretched, he offered me a $125 voucher if I wanted to purchase anything over $400 in the Apple store, and stressed he didn't have to do this but the company was attempting to provide good service to its customer.
Despite my argument that I forked out over $3000 for this laptop a mere three years ago and am now looking at over $1000 to repair something replaced only 18 months ago, his line was that Apple provided a warranty and that was simply that (apart from a month or two grace). Five months is apparently "far outside the warranty period".
I received no challenge to my assertion that after buying something which cost over $3000, it was reasonable for Apple to expect a consumer to pay an extra $1000 every year after the warranty finishes to replace a broken logic board. In truth, I find this near incomprehensible, considering one can buy the supposedly inferior build quality of a Dell, HP, Toshiba, etc and see it last not just beyond the warranty but another two or three years before it finally suffers something terminal.
While from a warranty perspective Apple are well and truly within their rights to refuse to pay for the part, at the end of the day I am left to pay $1000+ for a repair for something which may only last another 12 months, plus $3500+ for a new Macbook Pro with AppleCare if I want a replacement- minus of course the $125 they are offering.
I did some reading of the ACCC's website about my statutory rights and the Trade Practices act, and I note the following with interest:
*Statutory conditions (goods)*
The Trade Practices Act implies the following statutory conditions into consumer contracts:
* The goods must be of merchantable quality. That is, they must meet a basic level of quality and performance, taking into account their price and description. They also should be free from defects that were not obvious to you at the time of purchase.
* The goods must be fit for their purpose. That is, they should do what they are supposed to do and be suitable for any purpose that you might have made known to the supplier.
* The goods must match the description you were given or the sample you chose from. For example, any carpet laid must be the same quality and colour as the sample you chose from.
* You must receive clear title to the goods, including goods bought at auction. In other words, you can expect to own the goods outright and any restriction on ownership should be explained to you beforehand.
While I don't particularly want to make a big deal of things, I hardly see $3000+ for three years use and $1000 each year thereafter to be merchantible quality or fit-for-purpose! This is supposed to be a high end laptop with excellent build quality, and yet I've a secondhand iBook that has been chugging for longer without issue than this machine!
I told Steven from Customer Service that his offer didn't satisfy me in the slightest, and still put me in an awkward position with regards to repair and repurchase. He simply wouldn't budge, and refused to see things from my point of view (which another operator, Anu, was able to do and thus produce a much better response from myself). I have since asked to speak to his manager which- after initial resistance- I have been able to secure a future callback from. I have no idea how well discussions with he/she will go.
What I'd like to hear from you guys and girls is your experience with similar situations, and whether you think I've a leg to stand on with regards my replacement request or the ACCC stuff above. Again, I love my Apple products but I hardly think asking them to replace the part while I pay for labour is a big ask, given the service history and my desire to continue buying and using their products.

A lot of older participants here just talk about Aplle care, which seem the automatic thing in front of a lack of real good quality on Apple products .
But I think we pay the price, and my second hand MBP was much more expensive than a brand new PC with more ram, more Hard disk, and even a blue ray...
I don't know your mbp history, but that's sure that we are not equal, in world, with Apple customer support. France is not so great, I don't know for your country.
The only thing I think is that Apple should take care of us, as we have some unacceptable issues, for An Apple Product...
Since 1996, when Apple was almost dead, saved by Bill Gates investment !!! , I have every year promote it, and it was not easy, but I have bring to Apple between 3 to 10 customers each year..
since One year, I have stop that, because I don't believe anymore in Apple product's superiority .
Oh, yes, on the paper, it's better, the system is really good. But the overall experiment can be so bad that I don't want to loose friends, or customers...
I don't say it's always bad : I just say that it CAN BE SO BAD and that Apple DON'T take care of that...
so, for your computer, open it, check it a lot, may be it's too late, but for instance, you talked about a fan, I have solved that case just by putting oil on the fan's axe...

    I am Apple fan and use whole range of Apple products, (iPhone, Ipad, MacAir, Apple accessories like bulb, drones etc).
    I have started experiencing problem with my iPhone5 battery and phone started getting very hot.
    Since my warranty was expired and apple service is far from my office (if I have to go there , need to take half day off), I got the battery replaced at the local store in my office building. New battery didn't make drastic difference and still suffering from the same problem.
    Today, I came across this article on the battery replacement program and I got my serial number checked and I realized my device is one of those affected device.
    I call apple customer to get the battery under the program, according to them I am not eligible as I got the battery change elsewhere. If I have to get my phone repaired from apple Center, it would cost me $366/-. At the most they can do is the refund for the battery I bought I outside.
    This is really frustrating experience, being unfortunate to receive faulty device from Apple and further being resolving the problem without knowing the fact that there is some manufacturing defects in the phone.
    My phone replacement is due this month and I am not so keen to go for iphone after going through such bad experience.
    It may be not be big issue to loose one customer for Apple, but I still want to escalate my complain and highlight that after buying such expensive phone, I have to struggle to find solution and  solution offered by Apple is almost equivalent to new phone cost.
    I did not find any emailid to raise for such complain. Let me know if any one where I can raise my voice and pain.

  • Bad customer service and warranty question.

    I called a couple days ago to see if could get my lcd bezel fixed, since it just started to crack and the bottom (basically the back of the lid when it's close)  for no reason at all. if i dropped it or did something to break it, i wouldn;t even bother calling. but it just started doing this naturally so i;m worried that there might be a bigger problem. i didn't think it was a big deal, and i do have a warrenty for a reason, so i thought i might get it fixed before it runs out and the problem gets worse.
    To be clear, i have the warranty that came with the machine. I called Lenovo expecting the same great service, but i got something completely different. I explained my problem and the women just started speaking at a really loud voice "it's going to cost you $995 to get it fixed, Do you still want to do that" I told her that i thought that my machine is still under warranty and she told me that is not covered.
    Since i have my thinkvantage tool open to get the model number and everything, i can see that i have 60+ days left. so i told her that and she comes back with "let me check your warranty." I'm a very patient person and rarely get mad, but at this point i was kind of confused and mad that she would just give me an answer without checking. she told me that i was not covered with accidental damage and i don't think i am.  But when i told her that the damage is not by accident, she got very defensive and told me a lot of stuff i couldn't make out. such as "it will still cost you 995 dollars and it would just be a waste of time to send in your machine and get it sent back. and that all damage plastic wise, will count as accidental damange and if there is no damage, they send it back, it;s still gonna cost 995 dollars.  This is all i could understand, since she was being loud and her voiced cracked over the phone.
    To replace a piece of pastic should not cost anywhere near 995 with or without warranty
    so i guess after complaning for this long, here is the real question.
    Is that true, that the warranty that you get when you buy a machine does not cover plastic damage because it would be part of accidental and you do not get accidental protection when you buy the machine, even when the damage was not the result of an accident. this is not even a week after they replaced my power adapter and HDD.
    I do plan to call back, but wanted to see if i can get a straight forward answer before i do.

    Escalate your complaint to the customer service satisfaction officer. 
    There is no warranty agreement in your warranty booklet, which explicitly states that case or plastics fitting is not covered. In such cases, one should assume that it is covered, provided that you did not damage the part yourself.

  • Defective Batteries and Apple Customer Service

    I just spoke with Apple Customer Service today about the battery in My MBP 2.16CD, which is, according to them, defective. However, since it just recently became unable to hold a charge, and is 1 month out of warranty, they will not replace it. This is despite the fact that it only has 99 cycles on it, and will only hold a 1800mAh charge!
    I am very dissapointed that they would admit that the product is defective, but not offer any recompense. I know its out of warranty (by 1 month, it was a replacement battery) but it seems dodgy that they would refuse any sort of service. Has anyone had similar experiences? Is there any consumer legislation that can be brought to their attention?

    I have the same experience with a dodgy Customer Service. At a service point in my city they told me that they would repair the battery for free, but since i bought it at apple directly i should first asks permission via Customer Service. And after a 30 minute wait on a mobile phone they told me; out of warranty even though 70 loading cycles is not normal for a mac-book-pro battery. I send them a letter, but no response. They like to tell you that since its a battery, you can never claim more than the 1 year warranty; which i think is nonsense, since it is an advanced power device with its own set of chips en led indicators that happens to hold a battery. Anyway; very frustrating indeed to communicate with the boys and girls from Customer Service, and no positive result. It was my first experience with them [and i'm using apple since 1990!] and so far so bad.

    You should call Apple but you should get an email from Apple. I got one a few minutes ago and this is what they said about AppleCare+ :

    We would like to let you know that every iPhone comes with one year of hardware repair coverage through its limited warranty and up to 90 days of complimentary support.     hi i called the customer care to repair my iphone 5c and the advisor told me there are no Apple store in Belgium you have to go to paris, i have to pay 300euros to travel to paris !!! i bought a battery on eBay and i replaced the mine but the problem was not the battery but the logic board.
    i called i second time Apple customer care and the advisor told me you can take your iphone to Easy-m (repair center agreed by Apple inc.). i left my iphone to this shop and now he will not repair it for me because i opened this one.
    the first advisor told me there are no apple store in brussel and you have to travel to paris ... it's not my fault if the advisor was not good trained ... i bought my iphone and he still on warranty to 27 December i will this iphone 5c repaired
    it's a iphone 5c 16Gb from (sprint)
    if this iphone is not repaired i will do a complaint !!!

    Apple will not touch any iPhone that has been opened by anybody other than certified technicians, especially when they install an unknown battery from an unknown source.  You have sacrificed any support and warranty from Apple:
    "This warranty does not apply: (a) to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports; (c) to damage caused by use with another product; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause; (e) to damage caused by operating the Apple Product outside the user manual, the technical specifications or other Apple Product published guidelines; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Apple or an Apple Authorized Service Provider ("AASP"); (g) to an Apple Product that has been modified to alter functionality or capability without the written permission of Apple; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the Apple Product; or if any serial number has been removed or defaced from the Apple Product, or (j) if the product is stolen or Apple reasonably believes that the product is stolen based on information provided by law enforcement authorities."

    I am soooo disappointed with the apple customer service at the local store in Tampa......every time they give u an appointment and make people wait for hours......there was some cosmetic problems with the screen of my Mac book pro....they replaced it but the computer would not turn on....and btw when I went to pick up my computer the representative handover my computer to another guy without checking his id who was there to pick up his phone.......then I had to take it back second time this time they messed up my iWork...I took it back but they couldn't retrieve my history of purchase of iWork...and then when I installed the iWork at home...none of the applications is working.... .I will have to take is back fourth time.....I loved apple products but may be not anymore.......

    Other than what Shotist007's remarks (which solves nothing) your experience is not common. First I would speak to the store manager to get things rectified for you. If that doesn't work out then I would contact AppleCare and speak to a customer service representative and complain via that venue.

    the same problem happened to me also, i felt that while playing hay day, if some calls came in between and if i answered the call, the setting of all the icloud items turns off. (i have backup of all the items on icloud), after deleting the account and making settings of mail, contact, calander etc on on mode and after rebooting the phone, it again download from icloud server. but it is just a headache. do not know how to handle this.

  • Great Apple Customer Service!

    I have been plagued with Iphone 3g issues. A few of the problems have been bright pixels and dirt under the screen. The customer support has been great through the process of exchanging my Iphones. I am embarrassed to say that I have replaced my Iphone 5 times with the 6th Iphone on the way. With any other company they would have told me to deal with it, not with apple they have been very helpful and made me feel like my happiness is their number one concern. I just want to say thanks for such great customer service!

    Terrible Customer Service!
    I did NOT get my iPhone wet, but the mute switch on the side quit working. It moves like it is working, but it doesn't turn the ringer off. Vibrate still works, but I have to turn the volume down to get the "mute" the ringer. I went to the Apple store to exchange the adapter and thought they would of course cover my phone under the warranty. But found I had to make an appointment and come back to see someone about my issue. So I did. When I returned for my appointment, however, according to the "genius" that examined my phone - one of the moisture sensors had been tripped, negating the warranty. My phone is only three months old - I am the only one who uses it, and it has never gotten wet! But even the manager at the Apple Store - who never even looked at the phone himself - refused to honor the warranty. I couldn't believe it! I have been an Apple user and supporter for 20 years. I started on the Apple IIe. I currently have an new iMac and an older MacBook, that I was planning on replacing with the new MacBook just announced. I bought the first iPhone the day it came out, and the G3 as soon as it came out. I am in the education field, and I have argued with my colleagues for years about the virtues of the Mac vs. PC's. To say I have been a strong proponent of Apple would be a huge understatement. I have heard that as Apple is getting more of the market share, customer service and satisfaction have also gone down, while product quality has also gone down. But I didn't believe it. I have always been so satisfied with my Apple products. I can't believe they have this policy and refused to fix or replace my iPhone. I have no idea what would "trip" one moisture sensor. If it really got wet - wouldn't more than one sensor get wet? And besides that, how could that issue have anything to do with the mute switch on the other end of the phone - even a "genius" could figure this out. Instead of caring about my business and giving me customer satisfaction, they took the "easy out". I am very upset and disappointed about this response from a company that I have supported for so many years. I am only one customer, but a lot of people treated like me can make a difference. I feel like I have no recourse except through this website. I am very disappointed and frustrated.

    You cannot ship to an Apple store in another country - they will not
    accept the shipment.
    You must either take the iPhone personally to the country where the
    warranty is valid or send it to a friend/relative in that country. After
    repair/replacement, the friend will have to send the iPhone back to you.
    All shipping and insurance costs are your responsibility.
    Buy the iPhone where you intend to use it to avoid warranty problems.
    Some features (especially 4G/LTE) might not work outside the country
    the iPhone was meant for. KSA, UAE and some other countries block
    FaceTime from the iPhone and FaceTime cannot be installed on those
    iPhones even if used outside the restricted areas.

  • Complete apple customer service incompetence

    Well, I'm not sure where to post a statement like this but here goes...
    At the beginning of September, I had ordered a new 15 inch macbook pro from apple with the quicker hardrive, which proceeded to arrive within the the next week (good job there). The problem came when the trackpad and keyboard started to sporadically cease responding (while external keyboards and mice would function just fine). Eventually they stopped working all together. This was within the first week of owning the computer. After taking it to the nearest apple authorized dealer/repair shop, the computer was diagnosed with an extremely rare bug/flaw. Apple decided to take the computer back and do an exchange. The problem was, in order to send the computer back, I still had to wait for the special fedex shipping labels from them to arrive. After about a week the labels had not yet arrived, so apple gave me the special numbers without the label to get the computer shipped out any way. After the computer started its trip, Apple, given the tracking numbers was going to expedite the replacement to get things done as quick as possible. Its now October first, a month later, and I still have no Macbook Pro (which was going to be my college computer). Now it turns out someone at Apple customer service screwed up and cancelled sending out the replacement upon also canceling the labels that wouldn't be needed. So now the new computer was supposedly given the order to get sent out today, how long will it take this time? By the way, those labels arrived just last week. So now they obviously have the messed up computer, and my money, but I still don't have anything (except $50 dollars put back on the credit card). When does this start getting called theft?
    I love Apple products, I've been using them my whole life, but this is the worst case of incompetence in the case of customer service that I've ever seen.

  • Problems with Customer Service AND unexplained charges!

    I've been with Verizon for I-don't-know-how-many years, and through the years you are bound to have a few problems here and there but some of the problems are just ridiculous! It's also the same reocurring problem!!!!!!!!!!!!!!!! I was with Alltel first, before it was bought out by Verizon. The years I was with Alltel, I didn't have near as many problems. It seems EVERY time I do the smallest change or something to my phone or bill, I get a ridiculous amount of charges that I was NOT aware of, nor told about... EVEN IF I ask "So this isn't going to change my bill, or there will not be any unexpected/unexplained charges that I don't know about?"... BUT not matter how many times I ask... and NO matter how many times I am told "no"... there always is. For example.... last year, I updated and signed a new 2 year contract and purchased the first Driod. Before, my 30 day warranty was up, I was having problems with my Driod, and decided to send it in and get a new one. Before I did this.. I called customer service to make sure there would be no interuption in my bill, and there wouldn't be any unexpect charges, and there would be no difference in anything. I was told there was not, and once I recieved my new phone, just send it in and nothing would be changed. Of course, when I get my bill.. I see I was charged $500 for the new phone. It was explained to me that my credit card was reimbursed (which I never check that card, because I never used it expect to purchase the phone) and that I was recharged for the new phone, since it was a new phone. So I had to fork out the $500 (on top of my bill) and then wait months to get the $100 rebate card. Months after that, I "assumed liablity of my line" because I was on a plan with my family. I decided to have my own line, so I "assumed liability." I was not told that when I did that, I "renewed" my contract date. So I just added 6 more months to my 2 year contract. Was NOT told about that! Then again...... I was recently having problems with my Driod (the screen went black and would not come back on.) I had to turn on an OLD motorola razor, so I would not be without a phone for two days while I was waiting on my phone to come in. As soon as my phone came in, I had my Droid turned back on. I recieved my bill recently, and my bill was $200 over what it normally should be.... so I called in... apparently, when I had my phone replaced, they dropped off my data package and when I recieved my replacement driod, they never put it back on. So I was being charged for alllll my data usage... again I was NOT told about this. I wasn't even aware that they had dropped off my data package, and when/where did they get the authority to do that??? These are just a FEW of the problems that I have had.................................
    Does anyone have these reoccuring problems!?

    I understand that my bill can be viewed online, and I do view it fairly regularly, so if there are any unexplained charges, I can call Verizon asap. The problem does not come from me not understanding my bill, but from customer service. I have been with Verizon for a very long time, and it is a continuing problem. Where did Verizon get the 'OK' to drop my data package off my plan? Who authorized that?
    After calling Verizon and trying to find out the problem, the gentleman told me that when I activated on old phone while I was waiting on my new Droid to arrive, my data package was dropped off and I "should" have been told about that. When I reactiviated my new Droid, I "should" have called and had them restart my data package. I was not aware that when you activate an old phone that data plan is taken off your plan. In all my years of having cell phones, I never make two years with one phone. I have always, at one point, had to turn on an old phone, and my data package has NEVER changed. Why would I have my data package dropped and why would I have to call Verizon to have it restarted. I would never know to do that unless I was TOLD that my data packaged HAD to be re-added when I recieved my new phone, but I was never told of that.
    All of that is beside the point, the point is, Verizon was never given the authorization to change my plan. Never. My bill was taken care of and readjusted, and I am thankful for that. It does not change the fact it is always a hassle with Verizon Customer Service and I am always the one having to PROVE that I am not at fault, or that I was NEVER told of certian things. EVERY TIME I HAVE CALLED CUSTOMER SERVICE, I AM TOLD "I'M SORRY, THEY SHOULD HAVE TOLD YOU THAT."
    "they should" does not help my bill with the extra armount of charges.
