Debt Collectors

Here is a list of event which have left to debt collectors contacting me.
I rang BT to give 30 days notice of moving home.
I get home to find BT has been cut off the same day.
I ring BT to get it reconnected but they tell me I will have to sign up to 12 month contract.
I argue it was BT's fault and they say they will sign me up for a new 12 month contract but there will be no early termination fee.
I move home.
I call BT and ask to cancel the new account. They try to charge me early termination. I explain it should be no charge and to look at the notes.
BT agree and cancel my contract.
3 months later I receive an email from debt collectors for 0ver 350 pounds (whilst on holiday in USA).
I immediately call BT to resolve this. I wait in queue on my mobile for 15 mins. The operator says he will arrange a call back.
Call back never happened.
Online chat India were no help and could not understand this long story.
Please could somebody from BT read and understand this message and respond? I'm trying my hardest to sort this out but BT are not making it very easy at all.
Thank you

  • Debt collectors chasing me for an account that was...

    Hello all,
Received a phone call this afternoon from quite an aggressive lady from a company called Advantis and representing a third party called TDX.  She was quite cryptic at first and started out by asking me for lots of my personal details.  I went along with this for a while then decided I had had enough and I wanted to know what was going on.
She informed me that I owed (either her company or TDX, I'm not 100% sure as I had just woken up) for an outstanding BT bill of £197.  I told her I thought she must have made a mistake but she was not interested and just wanted to talk about payment.  She wasn't even able to give me exact dates or even the reason for the charges but did inform me that she worked for a debt collection agency.
I told her I would commit to nothing until I rang BT.  I got through to the BT call centre about an hour later and was indeed told I had owed broadband and line rental frees from July, August and September 2010 that they having tried to collect from me unsuccessfully had sold onto a collection agency.
I'm not currently a BT customer - I cancelled my last account with them at the end of May 2010 as I was moving house.  I told the call centre advisor this and he admitted that he could see on my account a phone call I made on the 29th May 2010 to cancel my account.  I had at that point paid the following months (June) fees.
However he then informed me that the cancellation had been cancelled!  He did not tell me by who though.  I assumed this was just a minor problem and he would be able to see that my usage (MBs) of the service ceased at the end of May and obviously a mistake had been made cancelling the cancellation.  I never used a phone from this line so it was all just rental and broadband.  He sounded positive that a favourable outcome could be arrived at but he would have to ring me back in 30mins.  Hate these ring back promises as I've been lied to in the past by some BT reps.
He did ring back, after an hour, but did apologise for this so I was happy enough - the conversation started well but then he informed me that the service had been used as he could see data totals for 3 months after I left my address.  I asked him how this was possible as I had moved out of the property and he basically said this was only possible if I had still been living there and using the service.  He basically implied I was lying and would have to pay the bill with the third party.
I have a letter from the company I rented the flat from informing me that I had given notice on the flat in April 2010 and would have to move out at the end of May - If I was still there and using the service I'm sure the new tenants would have spotted me!!!
I was then informed again that this was my debt and he could do nothing for me and I would have to pay it.  I re-iterated that I had left the address at the end of May and asked if there was any possible way this could have happened by accident - he said no the account must have been accessed by me or somebody who knew my password and from my flats landline!  I had never told anyone my password.
The account was finally cancelled after three months of non-payments and I was told they will have tried all ways of contacting me - nobody thought to Email me at my 10 year old BT Internet account though!
He ended the call by saying his manager would ring me in 2 hours time, 3 1/2 hours have passed since then!
From what I have read this seems like a friendly forum - If possible could anyone comment on the following please:
How and why would a cancellation be cancelled?
When investigating this before sending to debt collectors did nobody see the cancellation on my account and notice that my direct debits had been cancelled and think it was a bit odd?
How can my account run up data usage when I no longer lived in the flat or used the router or landline - I had moved 200 miles up the country and was using a Virgin service?
Does this cast doubt on the amounts of data I was being billed for prior to the cancellation, some of my monthly bills were very high?
Is my credit rating now trashed?
Why do BTs overseas call centres only ring back 50% of the time?
Sorry its so long but I wanted to give as much info as I could, hoping for opinions

Nobody from the call centre bothered to ring me back as promised yesterday.
I waited until 12.45 today to ring them again - spent 15 minutes on the phone explaining again to be told the they were having system problems and couldn't help me.
Was again promised a call back - 8 hours later still no call back!
If the debt collectors ring again I'm reporting them to the police and BT to the Office of Fair Trading.
If anyone from BT does read this can I have a job in one of your offshore call centres please - it sounds great, just keep promising callbacks that you never have to make!

  • Debt Collector sent letter to start sending payments directly to Capital One

So I had a judgement a few years ago from an old capital one card, been paying on it since to a debt collector (Hosto and Buchan). The last few months I kept sending a request for a current balance owed on it, but didn't hear from them. Sent a more formal letter the third time with my payment. Well about a week or two ago I got a letter from them stating they were no longer managing my account and to send payments to Capital One (they included a PO box to send it to) and returned my payment I had mailed in for last month.  Seemed kind of odd. So this month's payment is due this week and I was getting ready to send in payment to C1, but thought I'd post here first to see if this throws any red flags up to anyone, or if there's something I should do before just start sending payments in to C1?Thanks!Jen

  • IS THIS LEGAL?? Original Creditor listed as the Debt Collector instead of Capital One!!

I just checked Quizzle and I know that the scores are FAKO scores, but I was really checking the credit reports. I had to fill out a form to send in for my husband's and my reports as they will not allow us to pull online.  Anyway I found this!
Is is legal for Capital One to list PR as the original creditor??? We never signed any paperwork with PR!! They are the debt collector on my and my husband's reports!!

I would speculate that it is an error on the part of the party who produced the credit report rather than an inaccuracy of reporting to your credit file. The substance is unaltered... you have one OC and one debt collector.Assertion of "illegality" would be based on an assertion that they have intentionally misreported inaccurate information.I see no basis for making such an assertion.

  • Current BT customer sent to debt collectors for un...

    Hi,
Firstly I would like to point out, just so I don't have to repeat myself throughout later, that what I am about to describe can - at best - be described as appalling customer service. At worst it is probably tiptoeing around fraud.
I moved house in January after having a BT phone line at a previous address for 18 months, paying by variable direct debit. However the house that I moved to did not have a phone line connected so the move was pretty painful - BT were not any help here - basically it seemed like the only way to get it done was to apply for a new phone line here. So due to BT's processes, I guess I ended up with two accounts, all for the same person though in my application for this house I gave them my previous house and phone details.
I left the phone line connected at the old house for a couple of months to help the landlord out, and when the new tenants transferred the phone to themselves I was phoned by BT to confirm that I was happy for that to happen. I said it was fine and the last few months had been paid by direct debit as per normal - so I believed that this was the end of it. I was not told at this time that BT were about to charge me for the remaining time on a contract that I never renewed.
Now, 4 months later, I get a phonecall from a debt collection agency chasing money on the old account. I was surprised by this - since the account was paid by direct debit I didn't understand how anything could be outstanding. Its for termination charges, I was told. This surprised me because I had only ever taken out a 12 month contract - I would never had renewed it as I only had another 6 months left on the lease. It is doubly surprising since I am still a BT customer, and rather than telling me they sent it straight to a debt collection agency.
I have notified the debt collection agency that I dispute the charges. However, it is going to take someone from BT to sort this out, so please do. You have already damaged your customer relationship possibly beyond repair by sending me to a debt collectors rather than sending me a bill (I guess it was too much work to check your own customer database first).
Checking through the fine print of  your terms and conditions of one of the extras I had on the phone line, I see you have some ridiculous clauses in there to automatically renew a 12 month contract into another 12 month contract - I am surprised this is legal since effectively you are forcing people into a subsequent contract without their agreement. If that is legal it must be a huge benefit to the other unscrupulous companies out there!!! Anyway it also says that you notify the customers before you do so to give them the opportunity to opt out - I was never notified and indeed this was the first I heard about it. When I first signed up for my phone contract for 12 months there was no such clause and when someone upsold me (by phone) on the friends and family international plan they most definitely did not warn me that I was then forced to buy my phone rental from BT in 1 year blocks.
What I would like is for these - in my view, illegal, but at the very least non-contractual - charges to be removed from my account. I would also like to know what you recommend I can do to protect myself from this kind of unscrupulous business practise in the future.
I look forward to your response
    Steve

    Hi Steve and welcome
I too have had to discuss this with BT when I noticed that I was automatically signed up for another 12 months without any contract end date / contract renewal notification. They accepted that there had been a 'technical issue' and a note was placed on my file to say that I would not be held to terms of the contract. This was done over the phone but as you have written that you are looking forward to their response then you may wish to email the forum mods - [email protected] - with your account details. Theres a good chance they can sort this out for you.

  • BT sending debt collectors - I've never even been ...

I have received correspondence from a debt collection agency called ‘CCS’ with regards to a BT account I allegedly have. I have no account with BT, and for the two years I've been where I am, I've always used Virgin Media.
I am hurt and upset by getting demands for hundreds of pounds from a debt collection agency for a debt I do not owe. I am more frustrated that I have to waste my time at such a busy time of the year writing letters to companies who create phantom accounts and phantom debts, then drop a thuggish, bullying company round to people to try and make them pay money they do not owe. Times are hard for all of us, but having a monopoly on the vast majority of the country’s telecommunications system must put BT in a decent position to still make obscene profits without the need to create lies and try to threaten people into handing over vast sums of cash to them.
Where do BT get off thinking they can treat people like this? Why do they think I will pay this? How many poor and vulnerable people do they do this to? Is this going to have to go to court before it gets sorted, or will BT call off their dogs before?
Probably not a great forum post, just want anyone searching Google to be able to know this is what BT do to people.

    Hi Beardymouse,
Thanks for the post and welcome to the forum.  I am sorry you have been contacted by a debt collection agency.  I appreciate your frustration.  I can sort this out for you.
Can you please drop me an email to the email address in my profile, include any reference numbers you have in relation to this BT account, your full address and the link to this post.  I will check from my end to see what the mix up is.
    Cheers

  • Debt collector breaking the law

I received a letter in the mail from RMS claiming I owe $71.93 to Patient First. A principal amount of $31.37 and "other" fees totaling $40.56. I replied within 30 days with a debt validation request, which was received by RMS on 05/07/2015. On 05/29/2015, I received a letter dated 05/21/2015 labeled "Notice of credit bureau notification" from RMS stating I had 10 days to fulfill the amount or my information would be reported to credit bureau. At this point, my debt validation letter had not been responded to. I called RMS on 05/29/2015 and spoke with Jewel (x3144) who advised me the account was in dispute and that the documentation I requested was being obtained and my validation letter was received. On 07/15/2015, I received a credit notification (Equifax) of a new collection account in the amount of $71.93 from RMS. I placed a call to RMS at 4:00 P.M. on 07/15/2015 seeking information as to why my debt validation request was not responded to and why the account was reported to the credit bureau. I was told that nobody was available to help me and that I would need to leave a voicemail for "Joe" and was promised a call back immediately. At 6:30 p.m. I placed another call requesting to speak with Joe. After being connected with Joe, he confirmed that the account was forwarded to the credit bureau on 07/13/2015, that my debt validation request was received on 05/07/2015, and that a letter was sent to me dated 05/26/2015, acknowledging receipt of my debt validation request. Joe then asked me if I was willing to pay the principal amount of $31.37. In doing so, he would send me a letter saying the debt was satisfied and request that it be removed from my credit report. I declined the offer as I was still unaware of the debt and its validity. I politely asked Joe for his full name and he declined to help me any further and disconnected the phone call. As of today's date, I've never received validation of the debt. I was also asked several times why I don't remember the bill as it was from just December of 2014.

  • CBE collections debt, or phishing scam?

    Hello,
I've been a verizon customer since 2006.  I've kept the same number, but switched plans twice (from family to individual a couple years ago, and from individual to prepaid very recently).  About a month after switching to prepaid, I started getting calls (up to three times a day) from CBE collections group about an outstanding debt from verizon wireless of ~ $35.00.  I've always paid my bills online, using autopay.  When I checked my online account (which I've had for years), my balance was zero.  I've been to both of the local stores, and both told me as far as they could see, my account balance was zero and in good standing.  I've called verizon probably half a dozen times (with hold times up to an hour and multiple dropped calls), and talked to both customer care and financial services.  Everyone has been very confused, and told me my account is in good standing, and I owe verizon nothing, and they didn't know how to help me.  The most recent customer care rep actually told me with certainty that this sounded like a scam to her, and I should block the numbers and report it to the police.
When I've talked to CBE collections, they've told me they can't give me any kind of verification unless I give them my verizon account payment password (!!!).  However, they assure me that they are 'not a scam'.
Given my recent plan switch and the fact that CBE collections has a partnership with Verizon, I'm 90% convinced this is actually a legitimate bill that is being handled very badly.  I hope it's in fact a phishing scam-- if it's real, I am extremely angry about how it's been handled. I am very seriously considering changing providers.
Under the circumstances, I am hesitant to pay CBE without some kind of verification from Verizon.  How do I go about getting a written verification that this is a legitimate debt, when customer care has no information?  If it's not, how do I get a written verification that I can use to challenge any damage that CBE has done to my credit score?

CBE Group - Debt Collection Solutions
They are a legit company. But I would not give any account password or social security numbers or verify anything with them.
They could be zombie debt collectors or collectors that have no right to your Verizon account.

  • BT chasing me for debt I have been told I do not o...

    Hello,
I would like to seek some advice about my truly horrendous experience with BT.
To briefly explain the situation, I moved house on the 13th October 2011. I then arranged for BT to transfer my service to the new property on the 17th October 2011 and updated BT with my new address details at the same time. I had to take a morning off work to let in the BT engineer to carry out this work, which turned out to be a waste of time, as I will now explain.
When the engineer arrived he said that he could not install the phone line in a place where I wanted it, as he was only paid to reactivate an old line. As the old line was in the kitchen with no electric socket nearby I could not use it as I needed an electric point for my phone and modem. So I was left with a service that I could no longer use. As I was very dissatisfied with this, on the same day (17th October) I rang up one of their customer service representatives, where I spoke to a lady to explain that I wasn't happy with the service as I would be paying for something that I couldn't use. After spending about 45 minutes on the phone trying to resolve this matter, I was told that I could cancel my service and I wouldn't be charged anything. I was led to believe that my account would be closed without any further charges. I then rang back on the same day (17th October) to double check that I wouldn't be charged anything and clarify that there would be no charges left on my account and the SECOND lady I spoke to confirmed that I wouldn't be charged anything and that I wouldn't receive any further bills.
Following this however, I have since received bills that were being sent to my old address stating that I had charges on my account that need to be paid. A bill was sent in January 2012, so I rang their customer services department on the 28th January 2012, who put me through to one of their call centres in India. So I explained the situation again to the gentleman that I spoke to and I was then told for a THIRD time that I do not owe anything on the account. I recently received another letter (again, sent to my old address) dated 13th February stating that I owe £390.37. I rang their customer department immediately on the 21st February 2012 (the delay was due to the letter being sent to my old address, as fortunately the person living at my old address very kindly forwarded on this letter to my new address). During this call I was again put through to one of their call centres in India. I was kept on the phone for just over 45 minutes whilst they listened to recordings of conversations with their customer service representatives on 17th October 2011, confirming that I would not be charged. This ended up being a complete waste of time, as nothing was resolved and the person I was speaking to then decided that they would need to listen to the correct phone recordings and said that they would ring me within 48 hours to inform me of the outcome. This was particularly inconvenient, as I was due to attend an event that night and I missed it due to being late by being kept on hold with the call for 45 minutes. I had heard nothing of the outcome from this conversation until I received letter from BT's Debt Recovery Unit dated 5th March.
This has now resulted in me receiving a number of letters from BT's debt collection agency Commercial Credit Services and SC Gray Solicitors demanding that I pay £591.17 (again, letters were being sent to my old address). As I was getting no luck with trying to resolve this over the phone, I wrote a letter on the 15th March to explain what had happened. This resulted in a reply from BT to say that they have listened to the recordings of the phone conversations and they are standing by their view that I owe them money, even though at that point I had been told by THREE separate BT customer reps that I do not owe any money. Following this, I rang BT's general customer number as I could not get through to the lady who wrote me this letter and I was told by a FOURTH customer service rep that it states on my old account that "I have been promised that no charges or bills are outstanding on the account"!! So I wrote a further letter to BT dated 10th April and rang the debt collection agency (as advised by this 4th customer rep from BT) to say that I am disputing the debt. The debt collectors told me that they would contact BT to inform them that I am disputing the debt so that it can be escalated with the relevant managers. This clearly did not happen, as today I received another voicemail saying that they have listened to the recordings and they are standing by their view that I owe nearly £600. Clearly, BT are either listening to the wrong recordings (although I gave the names of the people I spoke to with the dates of the conversations) or they are being misconstrued somehow.
I find the behaviour of BT dishonest and unprofessional, and I feel like I am being bullied to the point of being physically sick with worry.
I would be interested to hear if anyone has any advice about my next steps, as I really am at a loss as to what to do? Any help would be greatly appreciated.
    Thank you in advance.

Unless this recording kit has a magic facility to record all the calls you had in the last 6 or 7 months, it will be of absolutly no use in resolving your issue.

  • SRJ Debt collection claim I owe BT a cancellation ...

I was so pleased to come across this forum via a search for SRJ Debt collectors.  I received a letter from SRJ today asking me to contact them urgently.   Clearly concerned, I called them and have been told that I owe BT just over £35 for cancellation of my phone service.
I moved house in April 2009 and informed BT well in advance of the move that we would no longer require their services.  I had been a customer at the address since July 2005 and was not tied into any package time agreement.
After moving BT contacted at my new address re the final bill which was settled and I eventually received a small refund for overpayment!!
I really could do without all the worry over this.  I know it's not a huge amount, but I have read so may horror stories this morning regarding SRJ.  My fear is that this is the start of endless letters and phone calls to very arrogant and unpleasant individuals, such as the person who took my call this morning.
Is there a BT number that I can call direct, where I can find assistance?
Thank you for taking the time to read this.

  • Getting bill collector calls for family member's AMEX

I was an authorized user many years ago on a family member's AMEX. My responsibility was terminated several years ago. AMEX only shows on 1 report as "relationship terminated" and nothing has been reported since 2008. I am even thinking that AMEX isn't even the AMEX that the bill collector is calling about, not sure. Obviously this family member hasn't paid their card. I am guessing the bill collector googled my name (very uncommon name, easy to find my land line phone #.)  I have excellent credit. Nothing can show up on my report, right? Collections, etc? I know bill collectors will do whatever it takes to get the money. Anyone have any similar experiences? I am in the clear, right? I have worked so hard to have good scores and I don't want it to go down the drain! Thanks for your advice!

    RobertEG wrote:
What did they say when they called? It is an express violation of the FDCPA for them to have informed you that the "family member" even owed a debt unless that family member is your spouse. All they can do is to ask you if you are aware of the current location of the named person. If they only asked for the permissible location information without any reference to a debt, I would assume they know that you are not responsible for the debt.Actually they didn't say anything about owing a debt. I googled the phone # and everyone said it was a bill collector for AMEX. I usually don't answer but I thought it was one of those "You have a problem with Windows" people because the caller ID said OPERATIONS DIV and that's what the caller ID said last time it was them. They keep calling every day so I felt like answering this time and telling them to stop calling and that my computer is fine and they are scammers (already did that once and it was fun). They asked for _____ and I said, no he doesn't live here and if I knew how to get a hold of him. I said no of course. And then I told them this is a work # (I work from home). Then they asked if they were speaking to ____ (me) and I said yes. I don't know why I even said that. They caught me off guard because I thought it was the "Windows Support" people at first.  Anyway, I just wanted some reassurance from the experts on here.  I have already blocked the # and some others I don't recognize. I have never dealt with a debt collector so I was just being paranoid that something like this could show up on MY credit report since I was on the card at one time. Sounds like I'm good and there's nothing to worry about!

No point. First, a DV is sent when, as stated in FDCPA 809(b), the consumer notifies the debt collector that "the debt, or any portion thereof, is disputed."Once a debt has been paid, there is no more debt. Second, even if timely, the effect of a DV is to impose a cease collection bar on the debt collector, which remains in effect until such time as they choose to proivde validation.  Payiment of a debt terminates continued efforts to collect on a debt, thus making a cease collection bar redundant and meaningless. Third, there is no period for or requiremnt to respond to a request for debt validation. With their collection activites terminated by payment, they could care less about responding, and can simply chuck in the trash. There is no such thing as deltion for lack of response to a DV request.

  • Over $20k med debt 2009. Never been contacted. Advice?

In late 2009, I acquired over $20,000 in medical debt in Texas, where I still live. It is now nearly 6 years later, which means I have just over 1 year left in the 7 year credit reporting period, and am well past the 4 year statute of limitations. The debt originated from Presbyterian and is currently with MEDREVSVC. I have always ignored my credit until a year ago, and as far as CreditKarma.com has stated, this information hasn't changed in the past year. I've never in this 6 years been called; never been successfully contacted in any way (that I recall) by the collection agency. I used to have a habit of hanging up every time a collector called and I stuck with that pretty aggressively. I've heard that if MEDREVSVC sells to another collector in this next year, the original 4 year statute of limitations remains, and I cannot be sued. I've also heard that if the debt collector is outside of Texas, that also makes being sued more difficult. I've heard that my debt could be sold at any time and that it would renew the 7 year period as a new collection under the new debt purchaser. Any chance that they'd just not sell it or that it could expire without issue? Not only have I heard it can be sold, but can be sold 100 times, so even though I can't be sued, I am going to have to address it. Is that right? Also, any advice on negotiating the balance? Is this possible? What are my options? I net $30k a year and save a semi-aggressive 35% and would love take care of this soon, but in the cheapest way possible. Advice?

That is not true. They can't sue you anymore. In another year it will fall off sold or not. So I would just wait it out. You should start opening some positive lines of credit.

  • Paid Collections Debts that are still reporting?!

I logged into Credit Karma to see if out accounts that had gone into collections had been closed, and were reported as paid or settled for less than full balance. I noticed one of mine is still showing open. And one of my husbands is also showing open. Each are showing the remainder of full balance that was left after what was agreed upon for the settled amount. Now I had been doing research for paying them off months prior. I was getting several calls a day from each company and waited until I had the full balance for each debt before I called.  I also downloaded a call recording app, so when I called each company I had the calls recording on my side as well. In my state only one party has to consent, and since I did recorded on my end as well. So I have the calls from both of these companies recorded. I also wrote down the information and got the names of the people I spoke to as well as their collector ID-if they had one. I paid from our checking account and asked several times over and over that that's the amount they were taking. And once I paid said amount, the account would be considered closed and satisfied. And them, nor any one else would show up looking for the remaining amount! They all agreed and the payments went through. I made all payments on 6/25 and was told letters would be sent in the mail. And I got them for most of them. The one of mine that is still reporting is from Portfolio Recovery Associates. It was my walmart account and I stopped making payments on it over a year ago. I owed $843 and paid paid $506 to settle it. They didn't want to settle for less than full balance. I told them we were considering filing for bankruptcy-which we were. The manage told me it was silly because it wasn't even that much debt. I told him he was the first of 7 more calls I had to make today, all of which were in collections. He agreed to $506 and I paid it. But it still shows it's open and last reported July 08,2015 and is showing Open with a balance of $337. And remarks say placed for collections. My husbands was his Continental Finance Card. It was still with the company and they had called us while we were on our way out of town. We were a few months behind but with the late and over fees that balance was over the credit limit. We told them we wanted to close the account and only wanted to pay the limit amount and a few fees. They told us we could make 2 payments and it would be settled. We told them we wanted to make a one time payment and be done. This call was also recorded. The balance at the time was $700. We settled for $385.27(+10.95) western union fee. We didn't want to risk mailing it in and it being lost and I wanted to be done with them. On my husbands CK it showing as past due AND sent for collections. The company it's showing is MID AMERICA BANK & T. Last reported July 14,2015. Payment status is COLLECTION/CHARGE OFF.Shows last payment as Account Status is OPEN. And shows a balance of $315. I have the western union receipt and the recorded call. Now my question is how do I approach these companies? I have the recordings of all of these calls. Where I asked repeatedly this amount once taken out will close this account and it will be reported as paid or settled for less than full balance, and I wouldn't have calls looking for the remaining balance? Everyone said yes each time I asked.  I don't like dealing with debt collectors but I am annoyed they are still on our reports!!!!!! Just want to know the best way to go about it and get it done quickly and make sure it doesn't happen again!

Anyone? I'm hoping to get advice so I can get it taken care of this week! Anyone else been in this situation?
