When I go to 'back up' or 'restore' the phone it looks like its working but then it pops up saying the phone 'cannot be restored at this time because the iphone software update server could not be contacted or is temporarily unavailable'. Any ideas?

Really? Are you sure? There is no mention of being able to do that on Apple's site I can find. It strikes me as being very easy to fake having purchased something from somebody. How is Apple supposed to verify you really purchased it and didn't just write out a receipt yourself?

I have used restore in iTunes to make it the same as my old iPhone and everything works fine except I have a list of artists and music in Music that are backed up to iCloud from the previous owner.
How can I delete these/
The previous owner says she has removed that iPhone from her list of devices in both iCloud and iTunes accounts but the playlists are still there.
Also when I try to register the device with Apple it states that the serian number is associated with another Apple ID.
Is it possible that there is a time frame here as i saw a dialogue box when first opening Music mentioning 90 days but it dissapeared before i could capture it.

There's no mechanism in place for anyone to report stolen phones to Apple thus they don't get involved. That job is for the police dept. Knowing what the seller needs to do before selling the phone might help you before purchasing it.
