I backed up my iphone 5 in itunes. I am now trying to restore to my new iphone 5S. It tells me it cannot restore because software is too old. To start as new iphone. If I do this how do I restore my information?

Backup from a later IOS version cannot be used to restore on iPhone with a earlier IOS version.
You need to update the iPhone to the latest IOS 7.1 version first before you can restore the backup.

yes, the software is on your Mac but it isnt licenced or owned by you so the digital rights management system Apple employs is blocking the application from being used. Its to stop illegal distribution of downloaded software.
my only suggestion is to phone Apple and see if they can transfer ownership

Unplug your Time Capsule from power. Wait 10 seconds and then power it on again. When the light goes green try backing up again.

The requirement for the latest iTunes (ver 10.7) is an operating system of Snow Leopard (Mac OS X 10.6). You will have to purchase Snow Leopard, available at 1-800-MY-APPLE for $19.99. Your i-device was not designed to be a reliable unique storage for your media. It is not a backup device and everything is structured around you maintaining your media on a computer which is itself backed up. Sync transfer is one way, computer to device, matching the device content to the content on the computer. If the computer has nothing on it, the device is set to match the computer's content -- nothing.The exception is purchased content.

Apple provides their framework for Windows to run on a Mac, a piece of software called a Hybrid MBR that bridges the gap between how Windows reads the drive partition table (MBR) and EFI/GUID partition table that Mac's use.
It doesn't mean Windows can't run on your Mac, a third party solution called rEFIt will also bridge the gap and allow booting of more that just Windows, Linux as well for a triple booting computer.
Your hardware has to meet the other requirements the second and third operating system needs as as being able to install drivers that will work for your hardware, especially the fans or they will run loud and fast by default.

This above is a advanced procedure which requires knowledge how computers and various operating systems, drive formats and so forth work.
I even admit I don't know everything myself, but I experiment on a separate piece of Mac hardware (out of warranty/AppleCare) designed for this purpose so in case something screws up I'm not taking down my only machine and can use the other to get online and find solutions.
There is a very high potential for losing your data if your using advanced/non-Apple methods to install Windows on your only Mac where Apple doesn't support it. Also one shouldn't be doing this on Mac hardware that is under AppleCare or warranty as it might be voided. Proceed at your own risk and education.

What version of iTunes are you currently running? To check, in iTunes go "Help > About iTunes" and wait for the version number to scroll up from the bottom of the screen. For example, I see:
iTunes: 10.5.2.11

Numbers 3.x can only open Numbers '09 and later. You will need Numbers '09 to open Numbers '08 files.
If it is a single file (or only a few) you can email me and I will open and convert then email back. My email address is in the "Biography" of my profile.
You may have Numbers '09 installed. Look in the folder "/Applications/iWork '09" if Numbers is in that folder launch it, open the file you tried to open, and save. Then you should be able to open in Numbers 3.x

What kind of photos are you talking about?
Ones in the iPod's Camera Roll album are included in the iPod backup that iTunes makes. Photos synced to the iPod or not and they are not in your iTunes library either. You have to back those up separately.
Also the iPod backup that iTunes makes is not included in your iTunes library. It location is listed here:

Go to Settings>General> Time & Date. Turn automatic time and date off and set it 1 year ahead. Access passbook and then tap App Store. Should get about 7 apps that come up that are available to utilize passbook. Go back into time and date and set it back to automatic. Should be good to go from there.
