I want to change my Apple ID on my device to my new ID but the device would not allow me to do that! how do I?

I have acquired a used iPhone. I want to set it up as my own. I want to change my Apple ID in the iCloud Settings og the phone to include my new ID but the iPhone is stuck on the previous one even though the phone has been dereigistered fom the old users account and I have reset an Apple ID on the site and on my phone. How do I change the Apple ID on the iCloud settings on the phone so that I register the phone on iCloud under my own account?

The previous user was supposed to erase the phone and remove it from their account, as explained here under "If the device has not been erased": http://support.apple.com/kb/TS4515.  Contact the previous owner and have them perform these steps.
