If you don't have Find My iPhone on, you can't lock it. You should report it to your carrier and your carrier might blacklist the phone from use.

I have a passcode for my iPhone, but I don't have the application Find my iPhone. Can I retrieve my photos, notes, reminders and all other data in my iPhone, I mean, if I bought another one, and connect it to my computer and go to iTunes then restore backup, cause I backup my iPhone last Oct 10, 2013, will I recover all the details in my iPhone that was stolen? What happened to the phone. Did it just go black? Did you try to plug it into Itunes and see if it can be seen or throw it on the charger. You can still try the reset procedure listed in http://support.apple.com/kb/ht1430 and see if the phone turns back on.
The only way to get things back is to have backed them up ahead of time.

I know It is just a key that allow you to set icloud account which makes your iphone safer .. threatens thieve and they cannot reuse it without correct icloud password that you entered. moreover your stolen iphone cannot be jailbreaking.. I m right.. ???? actually I mean Iphone security features are still not strong ..as of jailbreaking utilities such as icoughtu, igetu etc .. these apps are really deadly weapon of any users ... Ridiculous. Apple says "we aren't the police". In other words when someone calls to set up an account with Apple and gives them the serial number of their new phone (stolen from me) Apple allows them to activate it. I'm not asking Apple to turn in this thief. I'm asking them not to allow anyone to use MY phone.
When I call Apple they ask for my user name and password, etc. But a thief calls in with a phone that Apple knows is stolen and allows him to open an account.

What's going on is that Apple manufactures phones. That's it. Just like Samsung, LG, Nokia and Motorola. None of those companies is in the policing business. Apple doesn't "activate" the phone, the carrier does. You don't call Apple and open an account. You call a carrier. Carriers are the ones to block a phone from being activated on their service. Most don't get into the policing business either.
Call you carrier and the police and report the theft. That's all you can do.
