Will the 1 year warranty cover scratches on the back of my iPod touch? Perhaps give me a new itouch?

I have quite a few scratches on the back of my itouch, one really long one. I was wondering if I could go to the store with my "1 year warranty" and get a new one? My 1 year warranty is almost ending, so I wanted to see if this would work. Thanks

This warranty does not apply: (a) to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports; (c) to damage caused by use with another product; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause; (e) to damage caused by operating the Apple Product outside Apple’s published guidelines; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Apple or an Apple Authorized Service Provider (“AASP”); (g) to an Apple Product that has been modified to alter functionality or capability without the written permission of Apple; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the Apple Product, or if any serial number has been removed or defaced from the Apple Product.

    However, the broken screen is not covered by the warranty and voids the warranty for the entire iPod.
    Apple will exchange your iPod for a refurbished one for this price. They do not fix yours.

    My guess is with dents, they are going to tell you the damage voided the warranty

    A phone replaced under warranty will have the balance of the original warranty or 90 days, whichever is longer.

NOT ONLY SHOULD I GET A BRAND NEW REPLACEMENT AGAIN BUT I SHOULD ALSO HAVE MY YEARS WARRANTY I AM MOST CERTAINLY ENTITLED TO!
    Personally I think this is an outrage, and I believe I am entitled to the years warranty I paid for, and a replacement now as my 5-6 month iPhone's LCD has decided to completely pack in possibly costing me £30 for a new, none-genuine LCD that I would have to trust myself to replace.
    I deserve my full warranty, I feel like I have been scammed by a huge company that couldn't care less whether their products reach the customer with the sales of goods act i'm mind at all.

I hope you are accurate in what you are saying, I have not voided my warranty in any way, the iPhone I paid for had a fault that meant, for some reason not only did it think it was constantly on a docking station, meaning the speakers nor the volume would work, but it would overheat when charging, this was nothing that I did to the iPhone.
    so in that case I am still covered by the years warranty?
    this is great if I am, although I thought all refurbished replacements only had a 90 day warranty. so if you need a replacement, you've only got 90 days for a component to break in order to get a replacement, which I think is unfair in every way as a refurbished replacement is even more likely to go wrong, not only that but it is more likely to go wrong in a smaller amount of time too!
