I'd suggest restarting the iPhone, and then a reset, should restarting fail to resolve the issue.

All sorted! dont suppose you know how to fix another problem I have??? for weeks now, since updating to ios5 I think, for some reason every time I have tried to log onto app store it says CANNOT CONNECT TO ITUNES STORE. It's nothing to do with my computer, and I've been to the Geniius bar but they couldnt help and nothing I seem to do lets me update my Apps and even worse, I cant even buy any more. Any suggestions?

If you have a proper Invoice for the device that is locked Apple may give you a replacement for that but they will charge you a Nominal Fee for that. And the best option is as said above to contact the previous owner and ask him to erase and remove the device from his iCloud account.

How do I get past this to be able to purchase. I can purchase songs on my MAC and sync but itunes doesn't give the option to purchase ringtones on the MAC, just the iphone.

If the email hasn't arrived after a few hours and isn't in a spam filter, you need to ask Apple to reset your security questions; this can be done by phoning AppleCare and asking for the Account Security team, or clicking here and picking a method, or if your country isn't listed in either article, filling out and submitting this form.
They wouldn't be security questions if they could be bypassed without Apple verifying your identity.

That's Activation Lock. You will need to remember the Apple ID and password you used to set up the phone.
If you can't remember them, you can go to iforgot.apple.com to try to recover the information.
If you are the original owner of the phone & have proof of purchase, you can try calling Apple to see if they can assist also.

It isn't possible to create a rescue email address without correctly answering two of the questions. Nobody on these boards can reset them for you.

If you don't have a rescue email address (you won't be able to add one until you can answer your questions), or you aren't receiving the reset email to that account (and you've checked the spam folder on it as well as the inbox), then you will need to contact iTunes Support / Apple in your country to get the questions reset.
