I've Lost my iPhone somewhere and I think someone has picked it up and stolen it if they restore it by putting Into Dfu mode before they turn it on and use it after the restore will I still get an email from Find My IPhone  that its been turned on??

Doubtful.  The phone has to be turned on, have a data connection to the internet (wifi or cellular), and still have your iCloud settings intact in order to be tracked.  If it's put in recovery or DFU mode, this won't happen as your settings and data are erased.
