Why is it my pod touch 4th gen version 4.3.3 won't let me delete some pictures, says total gb is 6.5, and won't let me upgrade the firmware

My iPod touch is version 4.3.3 and recently I was thinking I'm sick of my iPods memory always being full so I can't take pictures. My memory has allowed at max 6.5 gb which is highly annoying so I started by trying to delete photos for room and I deleted about 300 and it didn't allow any more memory so I went to delete 41 more and they wouldn't delete for some reason. So I resorted to upgrading my I.o.s. But when I began downloading it onto my actual iPod an error popped up and it wouldn't let me.
So, my question is how do I get those 41 pictures to delete, make my max capacity of gigabytes higher than 6.5 when it's suppose to have 8, and lastly how can I get my iOS to upgrade?

    No. If the photos are in a backup you made already then you can get them back by restoring from backup.
    If they are in your PhotoStream you can get them from your stream. See that topic of:

    - Reboot the computer and delete the download and try again. The update file is located here:

    An "other" that large usually indicates that the "other" includes corrupted files.  Usually restoring from backup eliminated the corrupted files. However, sometimes restoring to factory settings/new iPod is required.

    [Music files are still there, and I can play them on my computer directly from the iPod [just one track at a time] but not in the usual way, through headphones.]
    On the Summary page of iTunes for the iPod, it shows 50-plus gigabytes of "Other" content and no music, which was not previously the case.  I assume this is related to the problem.
    I can bring up individual tracks on the iPod and see cover art, but cannot play the music.

    iCloud is free, iTunes match is $25 a year.
    I had the same problem and when I went to Settings I had 0 songs, even though they were obviously still there since I only had 15GB free on my 64GB device.
    I decided to do a complete reset/restore of my 4th gen iPod Touch, Bad move! I've been messing with it for hours, and it simply won't restore--it keeps hanging on a black screen with an Apple logo and a progress bar at about 10%, sometimes it goes completely blank and tries again, with the same result.     I'm ready to bang my head against the wall! I can put the device in recovery mode, connect to iTunes on my computer, and get it back to the setup screen, but when I go through the process again and try to do an iCloud backup I get the same reset/restore loop.
    I could start from scratch, but I really, really, really don't want to go through all of my hundreds of apps, reinstall them one by one, etc. etc. etc.
    I thought that once I started using iCloud, I didn't need to sync with iTunes anymore--guess I was wrong.

    - If you previously turned on FIndMyiPod on the iPod in Settings>iCloud and wifi is on and connected go to iCloud: Find My iPhone, sign in and go to FIndMyiPhone. If the iPod has been restored it will never show up.

    I just installed the new iOS 5 to my iPod touch 4th gen tonight and when I got home from dinner (about 10min ago) it still hadn't turned on after letting it sit plugged in for over two hours after the update.     Master reset...? Your device was jailbroken prior to you purchasing the device. The only symbol you should see on reboot is an Apple symbol. Download redsnow... google it! Download the latest version and your IPSW (ipod restore firmware) it has to be the correct version. And the "just boot tethered" should fix your device.
    But that's only if you didnt back the device up. If you don't care about any of the data on the ipod then you can simply open itunes navigate to the device and click the restore button. This will restore the ipod firmware and install a fresh copy. Good luck let me know if you have any problems.
