Careless? Possible, but unlikely. Most likely the phone was stolen from the first owner. It would be a VERY careless iPhone owner who did not erase their personal information from a phone before selling it, and to do that it is necessary to disable Activation Lock. In most places in the world knowingly using stolen property is a crime, so the fact that the phone doesn't work may be the least of one's risks. -

Sorry, but you can't use that iPhone. The activation lock is an anti-theft measure; Apple won't unlock that device for you.

You have two options:
1. Get the person to remove the Apple ID and password
2. Get your money back.
As it now stands, the iPhone is useless to you and cannot be made to work. Apple cannot do anything to make this work for you. -

If you are referring to Activation Lock, the password for the Apple ID signed into the device is required, there is no way around this. If you do not have the information and cannot contact the previous owner, the device is useless.

You can try to pull/erase this file:
/Macintosh HD/Library/Application Support/adoption.plist
Then reopen the app store, and go to the purchases tab.

I've seen many saying contact previous owner because apple won't look into it but I am the original owner and just need it to be reset because it went back to factory settings i do not have my email because it was from a year ago and i was stupid and forgot where i set it up because it was my first apple product. i have seen some answers saying they will if you have the original bill, please help! yes my friend ios 7 was already loaded on when i bought it. The person who sold it to me left the find my ipad feature ON. I called her and she said she would be in the next day to buy it back and since i actually belived her i threw away her phone number. i dont know what i was thinking
