Are reports created in VS2005 supported in VS2010 (CR13)?

Question

Does anyone know if reports created with Crystal Reports for Visual Studio 2005 are supported in the Crystal Reports for 2010?
If I upgrade the report (by opening in VS2010 and saving directly) everything is OK, but out of the box it returns an error "Index out of bounds" when I set the datasource. Upgrading the reports is not and option for me, because the reports are maintained by my customers and not by me.

The report is working fine. Let me explain my situation a bit further:
I got an windows application (created in VS 2008) that uses a .rpt (created in VS 2005) and it is running framework 3.5. This works just fine.
I created a new ASP.Net application in VS 2010 and installed the Crystal Runtime for framework 4.0 (CRforVS_13_0.exe) and placed the exact same code in this new application. Running this one failes with an error.
If I open the report in VS2010 and press save, it asks to upgrade the file and I accept. If i run the new application again it works fine.
(Note, the reports are file based and not included in the projects)
My code is something like:
CrystalDecisions.CrystalReports.Engine.ReportDocument rpt = null;
rpt = new CrystalDecisions.CrystalReports.Engine.ReportDocument();
rpt.Load("my file location", CrystalDecisions.Shared.OpenReportMethod.OpenReportByTempCopy);
ds = Businesslayer.LoadData();
rpt.SetDataSource(ds);        // <<<  this is the line that returns the error.
