My iphone 3s "lost" my contacts, no icloud or software update option in my settings

Question

This is the 2nd time my 3s "lost" my contacts (but not my itunes music). The first time this happened the contacts magically reappeared a week later. Before this happened I had an icloud option in my settings. Now, that's gone and there's no option for a software update. Can I connect my phone to a computer and get the latest iOS verson so I can get to the cloud to retrieve my contacts?

problem i have was i syncd from my fathers laptop / under my apple account the phone turned on and i though ok thats it sorted , wasnt until i got ebay apps etc that it stated i cand have the latest version unless im running ios 5 or abouve , will have to plug it back into the pc through itunes will this then give me the option to update , thanks for your reply
