Does anybody know of a lawsuit against Xfinity or Comcast for breach of contract. Here is a list of my complaints I sent to Comcast:. 1.  Your agent who installed my Internet and telephone stole a diamondand sapphire ring that was once appraised at $8,500.  I can't prove it,but he's the only one who has been in my house since I last wore it.  2.  My voice mail worked at first, but I started getting messagesaying "Sorry, we cannot open this web page." I wish I had printed out all the chats I had with your service department because I spent at least 24 hours total: chattingwith several persons over a period of two weeks or so. None of them could fix this problem. 3.  Not only did I lose my voice mail, I lost missed calls, answered calls, and the ability to block calls. 4.  At first I could get messages from my telephone.  Now I can't. 5.  Apparently, your security is nil, since someunknown changed my password. I live alone so theydidn't do it from here. What else are you allowing unknownsto do to my account? 6.  Because I have to hold half an hour to reachyour service department, it tells me you have plentyof service problems.  7.  You disconnected my speaker phone.  8.  Maybe I should have listed this first because it isof upmost importance.  Comcast will not let myanswering machine answer my calls.  I am old and crippledand cannot get to it before it answers.  At times it doesn'teven allow the phone time to ring.  9.  Over the last two days I have spent a total of almost14 hours on chats and phone calls to Comcast aboutmy problems. I chatted until my chat quit working. Now I have to rely on the telephone. 10 I have to go through all my problems beforethey say I need a level 2 technician.  I get disconnectedand have to call back, go through all their menus and get level 1again who says they can help me.   When they finishedhelping me, my Internet Explorer wasn't working with all myfavorites.  I use AOL free e-mail, which quit working. 11.  I get popups all the time, although my popup blocker is on.   There are other problems that I can't recall at the moment.      To sum it up, nothing I bought works. Since Comcast cannot, or will not, live up to their endof the contract.  I do not feel obligated to live up to mine. I tried calling your legal department and they wanted it inwriting so here it is.  Send it to them.   I am stopping my automatic billing.  Just for the record, I am printing this in case my saved mail disappears.  When I changed to Comcast/Xfinity, people warned me I would have problems. I can see from your many complaints that they were right.  I should have listened. Sylvia   

1) File a police report about your ring, make a damage claim to Comcast and make a claim on your home owner's insurance if you can. 
2) Back in March of 2013, the US. Supreme court essentially killed class action suits against companies like Comcast. (Comcast Corp. v. Behrend )
3) You can sue Comcast if you like, but be aware of the Binding Arbitration clause in the Residential User Agreement (See #13). If you didn't op-out in the first 30 days, you agreed to not sue Comcast to settle disagreements. 
4) You can elect to resolve your dispute through arbitration. You may open a case with the American Arbitration Association - Case Filing Services, 1101 Laurel Oak Road, SUite 100, Voorhees, NJ 08043, 877-495-4185
5) You might consider a complaint with your franchising authority. A franchising authority is the local municipal, county or other government organization that regulates certain aspects of the cable television industry at the state or local level. The name of the franchising authority may be on the front or back of your cable bill. If this information is not on your bill, contact Comcast or your local town or city hall.
6) You really don't want to deal with Comcast's legal team, you want to deal with Corporate Customer Service. Customer Service is there to help you, the legal team is there to protect Comcast.

    At places where I live where something like this might be need all they offer is 3G 20 GB plan. Kind of useless. I can get the 4G 20 GB plan at my address, but not the unlimited plan. Doesn't matter since I can get 30 Mbps from Charter with a 250 GB cap for $50 a month anyway. Speaking of  their "unlimited" plan. I love how "unlimited" is actually 50 GB. Talk about false advertising.
    My account is unlimited so why is there an issue if I go over 50GB?
    Per the Millenicom Terms of Service you agreed to upon sign-up, the unlimited service is for personal and family use and is not to be used for commercial purposes or as a public WiFi or broadcast to multi-dwelling units or any other extraordinary circumstance. Usage over 50 gigabytes in one month is not considered personal and family use and will alert our investigative team.
    Really? 50 GB is just 20 minutes of Netflix a day. I can't even remember the last time we used under 50 GB a month. Just 19 days into the month and we are at 67 GB and that's a low month for us.

  • Lawsuits against Adobe

    Now a day, Adobe makes it harder to uninstall their program (CS4 or CS5), is there anywhere where can I find the class action lawsuits against the Adobe, or where can I file a complaint with AG?

    Maybe it's consumers choice that they don't want to clean up their messy or poorly maintained hard drives. I believe because Adobe program make it messy, and make the PC poorly performance.

    Most people are grateful to Adobe for providing the Cleaner tool and use it to clean up their hard drive and get on with life. You seem to prefer to view its existence as a reason to sue Adobe. Good luck with that.

    Hello all, I have read the verizon privacy policy several times and still can't find the section on violating our privacy to assist our incompetent government.  I have an appointment with my attorney next week to get some feedback on filing a lawsuit against them.  I will post what I find out on here.  Please let me know if anyone else is interested in pursuing this cause with me.

    Verizon was obligated to comply with the FISA warrant.  Their failure was in their Privacy disclosure:  They did not indicate that such orders may exist. (And I did go back and re-read the **** thing.)  As for me, I'm going after the government.  I've already started talking to the ACLU to join a class.  In particular b/c I have no other carrier where I live, and the only declassified warrant applies to the only carrier I can use.  (Now, of course, it's accepted that all the major carriers were also served with these warrants, but the others have not been declassified.)  I suppose a case could be made for the failure of the company to advise customers of the privacy issue.  Good luck.

    I already had all of the features turned off, had 20% free, all transparency were turned off and a few apps were on refresh and now are all turned off.
    Like I said, my phone worked fine until I installed IOS 8 and now the screen will freeze intermittingly and runs very slowly when searching it. In other words IOS 8 significantly diminished the operation of a perfectly good phone and Apple will not let you roll it back to IOS 7. They F’d up my phone intentionally to sell us all the latest model.

    I was one of the many unfortunate individuals who ended up paying Apple the $310 repair fee (more than $400 total, diagnostics included) to fix what was a defective logic board causing constant kernel panics. I don't think the suit has come to a conclusion or a settlement has been reached, but after spending the last month or so on this board trying to diagnose my kernel panics, I figured many others with similar problems would be interested in knowing about this.
    If anyone has any more up-to-date information on the suit or on what individuals should do if they believe they fall into the Plaintiff Class, please share!

I get a message "your servers license has expired". While I can usually access my emails I cannot delete unwanted emails. This problem does not happen when I use Safari and Apple mail.     I am paying a large amount of money to Comcast for high speed internet and it is terribly slow.   I have been trying to get to my email for more than an hour and all I get is that spinning blue circle.  Please refund my money.

    I to have been having the same problem for months and I get ABSOLUTELY no where when I contact customer service.  I have tried the reboot and everything else.  I am really considering switching carriers at this point.  I have even pulled out the old blue ethernet cord to try and accomplish SOMETHING.  This is ridiculous.  I to pay a high cost for this service and NEVER seem to get it bit YET, Comcast wants their payment monthly!!!cpakker wrote:

    If your supposed to be getting 20 Mb/s down via your ISP and both Mac's are not getting that on the SpeedTest, then obviously your router appears to be the cause.
    Connect one Mac directly to the ISP's modem, power off/wait 30 seconds/then power on, then power on the Mac. The ISP will connect directly to the Mac, then run a SpeedTest.
    Then repeat the same for the other Mac. If both Mac's have a problem then it's possibly the ISP, the modem, your lines to them or on your property, or both Mac's are messed up.
    You'll have to keep searching for the cause. Call your ISP and ask then to run a test to see if your getting your 20 Mb/s to your modem, that should clear part of the problem.

  • Breach of contract or not?

    BT have failed to send me a paper bill despite several calls pointing this out to them. After being promised I wont incur any problems as it is not my fault I havent received a bill, I discovered I have been put on restricted calls for not paying the bill ( yep, the same bill I told THEM I hadnt received!!) I was told last monday that normal service would resume within 24 hours. Today I had to call BT again to point out that I still have restricted service and was told normal service would resume within 3 hours.3.5 hours later I called them back as still no normal service. Now I have to wait another 4 hours. If they fail to resume normal service yet again ( as I am almost certain they will) would this constitute a breach of contract as they are failing to provide me with the service? Please Help!!!

  • Canceling service due to breach in contract and avoiding ETF

    I have had Verizon Service since I first had a cell phone..about 20 years, now. Even though I have been frustrated, at times that there is no mechanism in the phone to let you know you are about to exceed your allotment of minutes and then having really hefty bills to pay, I've never had problems/issues until now...starting in May. Since I renewed my contact with Verizon and got an "upgrade", which was really a "downgrade" because I didn't want a smart phone and the Dare was no longer available, I have had major problems. I first got the KIN 2. The phone didn't work properly since I first got it. I placed numerous calls to Verizon about it. Then one day the phone acted like it was just turned on for the first time andit lost all of the contacts I had for the past 20 yrs. Because there was no back up assistant for it there was nothing I could do..some were very important family contacts that I cannot get unless they call me. The phone got worse and worse. After many calls, as I said, it was returned (after being given a really hard time and calling a lot) They tried to sell me the same phone but I was finally able to change it to an LG cosmos touch. They ended up sending a new Kin2 and the LG cosmos back and battery. Then  I called again and shipped it back and received the cosmos. It, too had problems from the start..many dropped calls, froze up to six times a day, alarm going off until it the battery died -unable to turn it off, and most importantly, it lost voicemails that were very important (such as lawyer calls, etc..). The battery wouldn't hold a charge. Both phones had numerous severe issues. When I took the LG to the store, they couldn't get it to do anything. At this point I had spent an enormous amount of personall time calling them and getting nowhere, getting so frustrated having to re-trll the story so many times.. I sent the LG back and was hesitant to even try another phone from Verizon. They sent another LG Cosmos. I have had it for about two and a half weeks and it has frozen once..which scares me. My account is past due but I wanted to be compensated for all the personal time, frustration, inept customer service, etc. I have had horribly unreliable phone service since May!. I called and spoke with customer service, told my lengthy story and asked to be compensated for all the trouble (especially the loss of contacts and lack of service) They said they would give me 59 dollars for my trouble if I upgraded to unlimited. UGH!! I then said that Verizon had a breach of contract by not providing me the service I was paying for. The guy insisted that I would be charged an ETF if I cancelled because I had an overage last month. I asked to speak to his supervisor. He said he'd call me the next day. Instead they turned off my service because my acct was past due and added a $15 late fee. I want to cancel for Verizon now. I am so angry. It IS a breach of contract,  righ? Terrible terrible service..never a problem before and I signed on for another two years when there are far cheaper phones out there because I was loyal to them.. I should add thatI have to have a reliable phone as I am a single parent of a child who is asthmatic. Please advise..I do appologize for this being so lengthy..my first post.. Verizon is about to lose a very loyal customer. I am so disappointed that at this point I would hire a lawyer if they refused to let me out without an ETF.

    {please keep your posts courteous} A simple search on ANY internet search engine reveals a vast number of complaints about Backup Assistant not working properly; both the online version and on the phones. 
    My son went from a Samsung Omnia to a HTC Incredible and it took my persistently calling and emailing Verizon to finally get it too work on the Android phone and be able to sync with the online information. I finally had to send screen shots because much like you every Verizon Rep assumed they knew exactly what my experience with their piece of crap software had been and kept telling me that what I was describing wasn't possible because Backup Assistant "isn't available on the Samsung Omnia".  However, Backup Assistant indeed existed PRIOR to the release of the first Android phone on Verizon; back when they had more Windows Mobile phones and catered to business users. After Android was a runaway hit and demand soared, Verizon changed the software to meet the new demand.

    If YOU had read the OP's post carefully then YOU would have caught on to the part of the post that states the bill is past due to try and get compensation for horrible service, customer service, and all of the trouble these non-working phones have caused.
    FYI: Verizon's failure to provide a phone that actually works as it is described can and should be deemed a breach of the contract on Verizon's part (from someone who DOES know something about contract law.
    And another thing, missing a call from one lawyer does not mean  that particular lawyer is certified in or specializes in consumer law. Yes, it is INDEED possible to have one type of an attorney working on one issue and then need to hire a DIFFERENT attorney to handle another type of issue.
