Contract Cancellation and Penalty Charges

I have recently received the letter from BT informing me of the impending price rise for line rental etc. I have generally been happy with BT but I'm now finding their basic price structure prohibitively expensive, so took the decision to move my business elsewhere.
I contacted BT last week only to discover that I was tied to a automatically renewing 12 month contract that doesn't end until next March which would cost me over £40 to terminate early. My issue is that I received no notice from BT that the contract was renewing before the anniversary and there is nothing on the regular bills or the account section of the website stating this date. BT assure me letter were sent but it seems a common theme that these don't always arrive. According to BT's T&C's these letters should arrive in plenty of time to cancel if required. I understand that this price change may also be viewed as a material change in the contract I hold and so should allow cancellation without penalty.
I raised a complaint to this effect as I feel these are extremely sharp business practices and generally unfair. I was told by the person raising the complaint it was basically a waste of time as these issues are regularly turned down. I received a call this afternoon stating the complaints dept was happy with the situation and would not be acting further.
From what I understand Ofcom has already reviewed this situation and next month Penalty charges are being slashed. Please could somebody let me know how I escalate my complaint to Ofcom and also if there is an exact date when these reduced penalties come into effect?

I can't believe this. I had exactly the same issue and looking at the date on your post, on the same day! My paper bill didn't arrive this month, it was due yesterday, today I received a call saying I had to pay my bill, so I checked online and noticed that the discount of my contract wasn't there.  I called them and they said they renewed my contract without my concent, neither my letter nor by phone. Like you they said a letter was issued, but I never got that letter because I had to complain from day one signing with BT, and I was desperate to get to the end of the contract. The person who picked up my call is some other part of the world, said I HAD to fulfill my contract whether i signed it or not. Obviously, they know nothing about consumers rights.
I'm not sure how to deal with the situation now because I'm not going to pay for a contract that I didn't agree to, neither will I pay for contract that increased in value, and a contracted that was set before the letter changing the line rental.
I'll keep an eye on this thread in hopes that someone has an answer for us. I'm sorry this has happened to you, but I'm glad in a way that my complaint is not the only one.

    Hi, just started another 12 month contract (I only realised this when I logged on today).  And I also see there is a price rise set for 28th April.  Can I use this as an excuse to leave early?
    I'm on  Unlimited Evening & Weekend Plan at no extra cost and I guess I cannot use the price increase as an excuse (to be honest I don't even know if the price increase affects me!?)

    see the BT terms and conditions sections 47 - 50. tried to post link but can't as a new user, anyway google "bt cancellation charges" and the terms and conditions for BT telephony, broadband, infinity, vision etc should be one of the first things you get.
    I have just cancelled my contract with them that was only 4 months into a 18 month contract, the fact that they are increasing the charges means under section 50 of the T &Cs above you are entitled to cancel your service with no early cancellation charges. Worked for me anyway, glad to get rid of BT, not really sure why I ever went back to them. Hope this helps someone else."

    In that case, you should look carefully at any paperwork that BT sends you, including the small print at the back of the little BT Update magazines that BT sends out from time to time.
    You have 10 days to cancel from when BT notifies you of the change.

    Do what Roger says above.
    Do you have 'in-app' purchases enabled on an iPhone/iPad or other device that kids or other family members use ?  That could be the issue.
    If not change your iTunes Store password to try to prevent whatever is doing this making further charges.
    Also if you can't find the cause, talk to your cc company.

    Depends on whether your carrier supports Personal Hotspot & how/if they charge for this feature. Some carriers include Personal Hotspot as part of your data plan, some require it be provisioned on your account. Contact your carrier & see what their requirements are. The fact that you have the Personal Hotspot setting indicates your carrier supports this feature.

  • Multiple Problems Throughout Contract - Failure to Disconnect when Request and Then Charged.

    So lets start with March 2012. I had to move to another house and I brought my FiOS with me. This is where the problems begin.
    During transfer it took over a week to get my old price grandfathered over which shouldn't have been such a big deal I've been a paying customer for almost a year now.  Note price should have been 79.99.
    They created a new account without telling me any of the information about it, putting in a phone number, giving me an email address or anything. This caused massive confusion on the bill when it was recieved saying I owe $200.00 months later [first bill I recieved]
    On return of old equipment they shut the internet off at my new house and after 6 hours on the phone with them they re-enabled it. To my suprise on the bill I recieved [First one] it was now at 129.99 per month!!! Not only that they added an Activation Fee!!!!!! What? All of this without my consent. Eventually I got the fee down to 90.00 Per month but they didn't refund me the extra 50.00 per month they had charged me. 
    About a month later I had graduated from school and went to the store to have it transfered over but they told me I could not due to past due bills because of how expensive it was and the confusion as I was paying to an old account which I never recieved credit from, the money seemingly disappeared as they said they'd "write me a check" or "credit my new account". 
    So I go to check my account today and find that I have an early termination fee, call in to learn that my previous land lord hard to call in and get the account canceled and that they won't wave the fee. 
    I'm not paying this $400.00 bill and when it is reported to a debt collector I will be disputing it with the evidence I've listed here.

    Sorry its the weekend and I don't know where to post this. I ordered my apple iphone 4 through the apple online store but changed my mind half way through and canceled the order. Then the second time I made a new order but canceled it again because I got another phone as a present. Last night it came as a surprise that I got charged $859 from my credit card. I have no known orders since they;re all canceled and would like my money back obviously. I rang my credit card provider and they said to ring Apple on Monday which i will. Can someone from apple please help me here? Would be greatly appreciated.

    No I did not change the email that I used to create the account.... Someone made new security questions and when I went to change them I had to verify and it sent the answers to an email address... Get this though... The email address that it sent the answers too waste letters in the middle were starred out like this t*****@aol.com. That's not my email. Why did it not send the questions to my apple ID email account right? if you know how to change the email to a new one that would be awesome if you could share that info with me.

    Bookmarks all Tabs now appears if you right-click a tab.
    You also can use Ctrl+Shift+d to call up that dialog.
    Certain items on the classic menus have become invisible when you use the mouse. I have no idea why that is; perhaps they didn't want to duplicate the right-click on tab menu item? Anyway, if you open the bookmarks menu with the keyboard, by pressing Alt+b, then you will see Bookmark All Tabs.

  • Ridiculous penalty Charges

    Just been told to leave contract will be charged 220 quid!! I'm actually moving in with someone to save for my own place and he already has BT so can't take it with me.
    I have Broadband Option 1 and anytime calls, been told my contract doesn't end till Feb 2013, I have no paperwork to tell me I had signed for an 18 month contract. I have asked them to provide some proof of that now.
    I don't mind paying a fair penalty charge but this is outrageous amount.
    What happened to the lower penalty charges by OFCOM?????

    I think you'll find a verbal agreement is a contract when it comes to telephone sales. If not then broadband, TV and mobile suppliers wouldn't have sales agents in call centres. By your reasoning, if a verbal agreement is not a contract, then BT don't have to provide what you agreed they would when the sale was made? Contracts work both ways. You agree to pay for the length of time agreed, and the company agree to provide a service for that length of time so long as payments are made. If not they have to be seen to be trying to rectify any issue within a reasonable time frame.
    There is a get out clause in that, if the speeds you're getting are lower than the minimum speed range expected for your line you can cancel in the first 3 months, no questions asked. This was brought in by the regulator last year.

  • BT Contract Cancellation - A potential Dominic Lit...

    Hello everybody, Im new to this but need some help/suggestions.
    Basically, we moved house recently and took out BT's 20mb Broadband and phone. Since joining we are not happy with any of it. The speed is around 5mb which is unnaceptable, were close to our GB useage and they charge a ridiculous amount per GB after this has been used. Added to this, they sent letter to us with the wrong name on the front, the customer service staff are very rude (Including the manager who I have spoken to)
    Anyway....Lets cut to the chase.
    Our service started on the 3rd June and on the 16th June (13 days after) we sent BT an email explaining that we want to end the contract. It says on the contract (which came into effect in March 2011), and I quote;
    "Once we have provided the service, you may tell us to stop providing it at any time by giving us 14 days' written notice"
    It says you may do this via phone, email etc so we emailed them on the 16th and got a call from them on the 17th stating that we cant get out of the contract. I read their terms and conditions only to be passed onto various people including the manager who told us that the terms and conditions do not apply for the broadband. He also kept telling me that it doesnt say that in their terms and conditions when it obviously does, it's in writing on a letter we have received and also on the internet.
    Can anybody advise us what to do next? We have the right to cancel but they are somehow able to lie to us whilst still taking our money. I cant believe how a manager can be so false and be a blatant liar, despite me pointing out the ovbious to him. Its like talking to a brick wall!

    Thanks for all the replies. Im pleased to say the issue has now been resolved - Well kind of anyway, but were happy with the outcome.
    Basically it was my Mom who took the contract out and she claimed that she was not told about the GB useage during the phonecall with BT. I wasnt sure of this obviously because I wasnt there at the time. The only thing I was so angry about was the fact that they were basically changing the contract agreement themselves even though it is in writing.
    They have investigated our complaint, listened to the phone calls and the BT operator did not tell my Mom about the GB useage so we were in the right.
    They have accepted this and upgraded us to the BT option 3 package for the same price, for a year. We now get unlimited GB useage and unlimited phone calls. The internet speed is still between 5-7mb but I think that is a fair result.
    The only thing left to do now is ask for a letter of apology of the manager "Jon" as he tried to belittle me on the phone stating that what I was saying was infact wrong.
    All in all though, its a fair result and thanks again to everyone on here

    Could somone please clarify contract cancellation charges for me? We have been with BT for five years now, so our initial contract has finished and each year it has been continued.  However, thanks to someone 'hacking' into our phone line, we incurred a bill of £250 which BT has declined to refund.  Anyway, because of this and a gross lack of concern for a good customer, we have decided to switch provider.  As a result of this we are now being asked to pay a charge of £96 because we are still in contract.  So far we have received mixed comments by friends and family,on whether this is correct or not so would appreciate any advice. We begrudge paying BT another penny after what's happened.  Also, we used to get emails letting us know when it was time to renew, we've not had a thing for several years! It's very annoying!

    I guess you're on an auto-renewing contract with penalties for early cancellation. These were outlawed by Ofcom from 31 December 2011 but any already in existence may still carry early exit penalties until the end of 2012.

    Conrad, thank you for your suggestion. I gave your suggestion a try but initially got a technical error and then appeared to be getting closer and closer to completing an order without the required information coming up so I chickened out. This also was fraught with difficulty as the cancel button seemed ineffective.
    I think I may have to use imjolly suggestions.
