Yes you can as long as the previous owner erased the iPad according to these instructions. If the previous owner didn't do this, contact him or her and ask for their help. If the last owner cannot be reached or will not cooperate, you will eventually run into problems that you will not be able to resolve and you will have a useless brick on your hands.

You should log out of the currently logged in account by tapping on the id in Settings > Store and you should then do Settings > General > Reset > Erase All Content And Settings to put it back to factory settings (which the previous owner should have done) - you can then sync your own content to it.

Go to Settings on the iPad, be on the General tab, and then go to the bottom where it says "Reset".
I recommend to Erase All Content and Settings, seeing as it's a used iPAd. Once that is completed, if it comes up to a screen telling you to plug the device into iTunes, follow that instruction. If it doesn't and you are already on iOS 5, you're set to go and it will guide you through the stesp to enjoy your iPad.
If it doesn't have iOS 5, plug it into your computer and open up iTunes after Erasing All Content and Settings, and follow the steps shown on your computer. If no steps show, go to the left hand side of the program and click 'iPad' and follow the steps. If no steps are given, click 'Check for Updates' if it didn't prompt you already to update your iPad.

On the iPad, go to Settings > General > Reset and select Erase All Content and Settings, or restore the iPad with iTunes on your computer as a new iPad.

You do not need a serial number to use it or to use iCloud.
You do however need the previous owners AppleID password to disable iOS 7 Activation Lock which is tied to their iCloud account. If you cannot get in touch with the previous owner to disable Activation Lock, then you will never be able to activate and use that iPad.

Using cintiq with cs6, cant find the grabber hand that was activated as an "appication defined" function in CS5. I need it to be momentary, NOT the permanent grabber hand activated by typing 'h'.

does anyone know how to program the CINTIQ pen to MOMENTARILY use the grabber hand to move my selection around? It worked fine in CS5, and now that ive upgraded to CC/CS6 i cant use the function anymore. I dont want to program the keystroke 'h' into the pen, as it requires another keystroke to exit the grabberhand function. help please?

It may sound odd but some Photoshop shortcut key like h for hand will switch to hand when you tap it. However if you hold down the key it works differently. If you hold the h key it act like a quick pan tool. When you click and hold the mouse button the whole image will be shown on screen with the mouse in a rectangle you position over the area you want to work on and then let go. Also holding the space bar down temporary switches to the hand tool.
Selections are moved by moving the mouse inside the selection with a section tool active then click and drag. If a selection too is not active holding the L key down mat temporary switch to a select tool.
Just did a test M or L can use to to temporary switch to a selection tool to move a selection.
I use the rocker on my Wacom pen set to X switch colors and space for the hand tool. I have a tablet don't know if I would like my hand on the display. I'm not a painter. You can use the keyboard and the Pen together try the H key held down for panning,
