Go to http://appleid.apple.com and sign in. Click on 'Password & Security' in the left sidebar. On the right you may see a link saying something like 'Send Security answers to...' and a partial email address. If so, click this to get the answers.
If this doesn't work you will have to contact Support. Go to https://getsupport.apple.com ; click 'See all products and services', then 'More Products and Services, then 'Apple ID', then 'Other Apple ID Topics' then 'Forgotten Apple ID security questions'.

I have attempted to upgrade os4 to os7. At the end, it threw an error that i had to turn off "Find my iphone" on my phone, which seems to be impossible at that stage as i could not access beyond the upgrade screen.
I thin chose to set up as new iphone, but icloud has taken an old expired email address for which i do not know the password. icloud will not recognise my current itunes email and password, so i now have os7 but am unable to restore from my itunes back up.

ThankyouIf you don't know your password, don't know your security questions and don't have a rescue address or don't receive a reset email, you should contact AppleCare who will initially try to assist you with a reset email or if unsuccessful will pass you to the security team to reset your security questions for you.
If you are in a region that doesn't have international telephone support try contacting Apple through iTunes Store Support. -

As i dont know the password, it is restricting my use of the phone, as the verification box contiually reappears. It has stopped doing it now for reasons i do not know, but how can i prevent this in the future?

If None is not available - On your computer launch iTunes and click "iTunes Store" in the left navigation pane. If you're able to contact the person who set the lock, send them this link and tell them to follow its instructions.
If not, you can't use the device but may be able to get it refunded. Apple won't remove the lock for anyone other than the original owner(assuming they're alive.)

If you have a rescue email address (which is not the same thing as an alternate email address) set up on your account then go to https://appleid.apple.com/ and click 'Manage your Apple ID' on the right-hand side of that page and log into your account. Then click on 'Password and Security' on the left-hand side of that page and on the right-hand side you should see an option to send security question reset info to your rescue email address.
If you don't have a rescue email address (you won't be able to add one until you can answer 2 of your questions) then you won't get the reset option - you will need to contact iTunes Support or Apple to get them reset.
e.g. you can try contacting iTunes Support : http://www.apple.com/support/itunes/contact/ - click on Contact iTunes Store Support on the right-hand side of the page, then Account Management , and then 'Forgotten Apple ID security questions'

I got some help from an apple assistant on the phone. It is kind of round about way to get in.
Here is what he said to do and it is working for me...
a. on the device that is asking you for the security questions go to "settings", > "store" >
tap the Apple ID and choose view"Apple ID" and sign in.
b. Tap on payment information and add a credit/debit card of your preference then select
"done", in the upper right corner
c. sign out and back into iTunes on the device by going to "settings"> "store" > tap the
Apple ID and choose "sign-out" > Tap "sign -in" > "use existing Apple ID" and you
should be asked to verify your security code for the credit /debit card and NOT the
security questions.
d. At this time you can remove the card by going back in to edit the payment info and
selecting "none" as the card type then saving the changes by selecting "done". You
should now be able to use your iTunes store credit without answering the security
questions.
It's working for me ...I just have to put in my 3 digit security pin from the credit card I am using.
